Two public hearings have been announced by DEP on their proposed Clean Energy Standard (CES). This standard would increase annually the amount of non-emitting energy that utilities are required to use, hydro and nuclear would be included in this standard if built before 2010.
At the moment municipal light plants are exempt from the standard but DEP has proposed amendments that would include municipal light plants.
MassDEP is seeking stakeholder input on increasing the stringency of the standard, applying the CES to municipally-owned utilities, and including existing clean generation resources.
The proposal to include MLPs can be found online here. The proposals for including MLPs can be summarized as follows:
- Reducing or gradually phasing in the requirement,
- Setting a threshold that would exclude the smallest MLPs,
- Or monitoring-only voluntary approach to complying.
The last proposal is what is effectively in place as of right now. As is evident from the current regulations, voluntary-based approaches to standards are simply not effective.
